• Police Reform Act 2002
  Sets out the framework for the police complaints system

The following legislation has amended or replaced some of the legislation detailed in the before 1 December 2008 section below to bring in a new misconduct system. This will come into effect for complaints, conduct matters or death and serious injury matters that come to the appropriate authorities’ attention on or after the 1st December 2008.

From 1 December 2008;

• Schedule 23 of the Criminal justice and Immigration Act 2008
  Amends schedule 3 of the Police Reform Act 2002
• Police (Complaints and Misconduct ) Amendment Regulations 2008
  Amends the Police (Complaints and Misconduct) Amendment Regulations 2004 and applies to cases from 1 December 2008
• Police Conduct Regulations 2008
  Replace the Police Conduct Regulations 2004 and apply to cases from 1 December 2008
• Police Amendment Regulations 2008

Before 1 December 2008;

• Police Complaints and Misconduct Regulations 2004
• Police Conduct Regulations 2004
  These regulations provide further detail on the operation of the police complaints system, including mandatory referrals (misconduct)
• Serious Organised Crime and Police Act 2005
• The Serious Organised Crime and Police Act 2005 (Commencement No. 1, Transitional and Transitory Provisions) Order 2005
  Sets out the framework for the new Serious and Organised Crime Agency, including the complaints system
