In the case where UKBA officers, or certain contracted staff employed by UKBA carried out an immigration or asylum function, the IPCC can only oversee complaints that involve both:

However, the IPCC can oversee serious matters relating to UKBA staff or relevant contracted staff employed by UKBA when they have carried out customs functions regardless of whether or not they have exercised a police-like power.
