How to appeal?

The IPCC is responsible for considering appeals made by members of the public in relation to serious complaints against UKBA in England and Wales.* It has powers to overturn certain UKBA decisions.

The IPCC does not have any power to consider appeals in relation to less serious complaints about staff, contracted staff employed by UKBA or complaints about overall UKBA policies.

Appeal against the non-recording of a complaint

UKBA has a duty to record your complaint about the conduct of a member of staff, relevant contracted staff or give you reasons why it has decided not to record your complaint.

You may be able to appeal to the IPCC if you have tried to complain about one of the following and UKBA did not record it:

  • a serious complaint about a UKBA officer or relevant contractor emplolyed by UKBA who was carrying out a customs function
  • a serious complaint about a UKBA officer or relevant contractor employed by UKBA who was carrying out an immigration or asylum function while exercising police-like powers

Appeal against the outcome of a UKBA investigation into your complaint

You may be able to appeal to the IPCC about the outcome of an investigation when:

  • a serious complaint has been locally investigated by UKBA
  • a serous complaint has been investigated by UKBA or the police under the supervision of the IPCC

UKBA will write to inform you of your rights of appeal to the IPCC against the outcome of an investigation.

Due to legislative amendments, if you made your complaint on or after 5 August 2009 you will have the following additional rights of appeal after your complaint has been investigated:

  • if UKBA decided not to refer your complaint to the Crown Prosecution Service
  • if UKBA decided not to take an action which was recommended in the investigation report
