Prosecution
The law requires the IPCC to refer any investigation report to the CPS where it appears that a criminal offence may have been committed*. Prosecution decisions are a matter for the CPS alone, but the IPCC fully support the decisions the Crown Prosecution Service (CPS) made to bring charges under the Health and Safety at Work Act.
The CPS held that the Office of the Commissioner of the Metropolis was the corporate body responsible for the failings under the Act. No criminal charges were brought against any individuals.
* This has been amended by the Criminal Justice and Immigration Act 2008.
